These Terms of Sale govern your purchase from PosGear, the online store operated by Al Kays International LLC (Commercial Registration No. 1795414, VAT Registration No. OM1100141365), Sultanate of Oman (“we”, “us”, “PosGear”). By placing an order you agree to these terms. Please read them together with our Privacy Notice, Delivery Policy, Returns & Replacements Policy and Warranty Policy.
1. Products & availability. Product descriptions, images and specifications are provided in good faith and are indicative. We sell genuine, sealed products. Stock is confirmed when your order is placed; if an item becomes unavailable, or if there is an obvious pricing or description error, we may decline or cancel the affected order and refund you in full.
2. Prices & VAT. All prices are in Omani Rial (OMR). Value Added Tax (VAT) at 5% applies to taxable goods and is added at checkout; your tax invoice itemises the net amount, the VAT, and the total. Delivery is charged as shown before you pay.
3. Ordering & payment. Payment is taken securely through the Thawani payment gateway. Your contract with us is formed once payment is received and we send you an order confirmation. We do not see or store your card details — these are handled entirely by Thawani.
4. Delivery. We deliver within the Sultanate of Oman only, by Aramex, typically within 48–72 hours. Goods are delivered duty-paid (DDP): the price you pay at checkout is the total — there is nothing extra to pay on delivery. See our Delivery Policy for details.
5. Title & risk. Risk in the goods passes to you on delivery. Title passes to you once we have received payment in full.
6. Returns, faults & warranty. If an item is faulty or dead-on-arrival, you are covered — report it within 15 days (see our Returns & Replacements Policy). All products carry the manufacturer’s warranty, honoured locally by Al Kays (see our Warranty Policy). Nothing in these terms affects your statutory rights under the Oman Consumer Protection Law.
7. Your responsibilities. Please provide accurate delivery details and a reachable mobile number, and be available for the courier, who may call to confirm your location.
8. Liability. To the fullest extent permitted by Omani law, our total liability for any order is limited to the value of the goods purchased, and we are not liable for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded, or your rights as a consumer.
9. The website. The website is provided on an “as is” and “as available” basis. We take reasonable steps to keep it accurate and available, but we do not warrant that it will be uninterrupted, error-free or free of viruses, or that any defect will be corrected. Descriptions, images, specifications and prices may occasionally contain errors, which we may correct at any time before accepting your order. The website may link to third-party sites, which we do not control and are not responsible for.
10. Security & unauthorised access. We take reasonable technical and organisational measures to protect the website and the personal information we hold, including using the Thawani payment gateway for payments (we do not store your full card details). However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. To the fullest extent permitted by Omani law, we are not liable for loss or damage arising from unauthorised access, hacking, malware, viruses, denial-of-service or other malicious acts of third parties that occur despite our reasonable security measures and are beyond our reasonable control. This does not limit our liability for fraud or gross negligence, nor any right you have under applicable Omani law.
11. Dropship fulfilment. Some products are dispatched directly by our suppliers or distributors, so dispatch origin and lead times may vary. Your contract of sale is with Al Kays International LLC in every case, and your VAT invoice, warranty and support are provided by us.
12. Intellectual property. All content on this website — text, images, logos, and the PosGear and Al Kays names and marks — is owned by or licensed to Al Kays International LLC and may not be copied or reused without our permission.
13. Acceptable use. You agree to use the website lawfully and not to disrupt it, attempt unauthorised access, introduce malicious code, or misuse it in any way.
14. Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including supplier, courier, payment-provider or telecommunications failures, or acts of government or nature.
15. Severability. If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect.
16. Governing law. These terms are governed by the laws of the Sultanate of Oman, and any dispute is subject to the jurisdiction of the Omani courts.
